From the stormy night that Watson writes about in "The Five Orange Pips" ("the wind cried and sobbed like a child in the chimney") to the torrents in "The Golden Pince-Nez" (requiring "overcoats and cravats and galoshes, and every aid that man ever invented to fight the weather"), it's simply part of the accepted climate of England.</div><div><br /></div><div>In "The Resident Patient" though, we find them curled up in the confines of Baker Street as the October weather whips around outside. In that opening, we find this lovely paragraph:</div><div style="text-align: left; text-indent: 0px;"><span style="text-align: justify; text-indent: 1em;"></span></div><blockquote><div style="text-align: left; text-indent: 0px;"><span style="text-align: justify; text-indent: 1em;">"I cannot be sure of the exact date, for some of my memoranda upon the matter have been mislaid, but it must have been towards the end of the first year during which Holmes and I shared chambers in Baker Street. It was boisterous October weather, and we had both remained indoors all day, I because I feared with my shaken health to face the keen autumn wind, while he was deep in some of those abstruse chemical investigations which absorbed him utterly as long as he was engaged upon them. Towards evening, however, the breaking of a test-tube brought his research to a premature ending, and he sprang up from his chair with an exclamation of impatience and a clouded brow.</span></div><div><p style="margin-bottom: 0.25em; margin-top: 0.25em; text-align: justify; text-indent: 1em;">'A day’s work ruined, Watson,” said he, striding across to the window. “Ha! the stars are out and the wind has fallen. What do you say to a ramble through London?'"</p></div></blockquote><div><p style="margin-bottom: 0.25em; margin-top: 0.25em; text-align: justify; text-indent: 1em;"></p></div><div><br /></div><div>There's an interesting asterisk that goes with this opening, however: if you're reading the book version of "The Resident Patient" as found in <i>The Memoirs of Sherlock Holmes</i>, you'll note that the famous "mind-reading scene" from "The Cardboard Box" is included (it was added to RESI when <i>The Memoirs</i> went to print, as CARD was omitted due to concerns over is risque content). Once all players have chosen their card, the cards are flipped and each player spends the required number of BSI tokens based on the cost in the bottom right corner of the card.</div><div><br /></div><div>Next is the arrest phase. Player order follows the arresting order board, starting with position 1, where each player decides if they will arrest an active villain. To arrest a villain, a player must posses evidence cards with the icons matching the icons at the bottom of the villain card. If a player chooses to arrest a villain, they take that Villain card and flip over their evidence cards used to arrest them. A new villain is drawn to replace the  spot, and the player’s cube is moved to the bottom of the arresting order, and all other cubes are shifted up.</div><div><br /></div><div>Once each player has decided to arrest or not, the tailing phase begins. Again, player order follows the arresting order board, each player has the opportunity to use one BSI tokens to tail a villain. To do this, a player places their token on a villain. During a later arrest phase, that villain will now require one less icon to arrest for that player. Players are not allowed to tail more than one villain and only get their BSI token back if they or someone else arrests that villain.</div><div><br /></div><div>After the tail phase, players pick up the cards passed by their neighbor and start the next cycle’s arresting phase. This cycle is repeated 4 times per round. On the fourth cycle, during the investigate phase, each player will choose one card and discard the other to the center of the table. After the 4th tail phase of the round, players will start the BSI Bonus phase. Here the remaining Evidence cards, along with the Holmes, Wiggins and Watson character boards are placed in the center of the table. Starting with the player with the most remaining BSI tokens and going in descending order, each player chooses one item from the cards and boards in the middle of the table. At this point, players take back all their spent BSI tokens and prepare to start the next round.</div><div><br /></div><div>This process is repeated over 4 rounds, each round starting with being dealt 5 new evidence cards and revealing a new plot twist card. After 4 rounds, each player totals up their victory points based on villains they arrested as well as the secret objectives on their inspector cards. The player with the most victory points is crowned as Rival to the Sherlock Holmes and is the recipient of the metal Holmes trophy included in the game… until the next time the game is played when they must prove their skills as a detcetive again.</div><div><br /></div><div>The game plays 1-4 players (possibly 5 if stretch goals are met), ages 12 and up and plays in 30 to 45 minutes. "Holmes drove in silence, with his head sunk upon his breast, and the air of a man who is lost in thought." He appreciated Watson's willingness to allow him to think to himself and expressed it after complimenting Watson's gift: "It makes you quite invaluable as a companion."</div><div><br /></div><div>It's clearly something Watson is comfortable with. In "The Yellow Face," he mentions another extended silence in Holmes's presence: </div><div><div><blockquote>"For two hours we rambled about together, in silence for the most part, as befits two men who know each other intimately."</blockquote></div></div><div><br /></div><div>Silence proves useful for Sherlock Holmes in a number of instances as he ruminates on details and conversations.</div><div><br /></div><div>In "The Five Orange Pips," Watson tells us Holmes </div><div><blockquote>"sat for some time in silence, with his head sunk forward and his eyes bent upon the red glow of the fire. Then he lit his pipe, and leaning back in his chair he watched the blue smoke-rings as they chased each other up to the ceiling."</blockquote></div><div><br /></div><div>After a visit from Lord Bellinger and the Right Honourable Trelawney Hope in "The Second Stain," Holmes needed to consider all angles of attack:</div><div><div><blockquote>"When our illustrious visitors had departed Holmes lit his pipe in silence, and sat for some time lost in the deepest thought."</blockquote></div></div><div><br /></div><div>Sherlock Holmes took his business seriously. After listening to Helen Stoner's harrowing tale, </div><div><div><blockquote>"There was a long silence, during which Holmes leaned his chin upon his hands and stared into the crackling fire."</blockquote></div></div><div><br /></div><div>And then there are instances of Holmes and Watson waiting in silence: standing together "in the darkness" awaiting Moran [EMPT]; "for a minute," as they expected Abe Slaney's imminent entrance [DANC]; "crouched among the bushes" outside of Peter Carey's cabin [BLAC].</div><div><br /></div><div>In some cases, Holmes needed silence to affect a particular outcome, such as in "The Three Gables," when he listened for Susan, wheezing at the door:</div><div><div><blockquote>"Holmes raised his hand for silence. Then he strode across the room, flung open the door, and dragged in a great gaunt woman whom he had seized by the shoulder."</blockquote></div></div><div><br /></div><div>And probably the most famous bit of silence in the Canon was the dog who did nothing in the night-time in "Silver Blaze." Holmes explains his reasoning:<br /><div><blockquote>"Before deciding that question I had grasped the significance of the silence of the dog, for one true inference invariably suggests others. The Simpson incident had shown me that a dog was kept in the stables, and yet, though some one had been in and had fetched out a horse, he had not barked enough to arouse the two lads in the loft. Obviously the midnight visitor was some one whom the dog knew well."</blockquote></div></div><div><br /></div><div>Meanwhile, the cat hasn't got Stamford's tongue. The series is being adapted for film, starring Millie Bobby Brown in the title role.</div><div><br /></div><div>And now, just months before the movie's intended release, the CDEL is claiming copyright infringement and trademark violations.</div><div><br /></div><div>If this sounds familiar, it should.</div><div><br /></div><div>Recall five years ago, when Mitch Cullin's <i><a href="https://amzn.to/3dtqu6Q" target="_blank">A Slight Trick of the Mind</a></i> was turned into the film <i>Mr. Holmes</i>, <a href="https://www.ihearofsherlock.com/2015/05/conan-doyle-estate-sues-mr-holmes.html#.XvWZ1kVKjb1" target="_blank">the Conan Doyle Estate, Ltd. sued Miramax to stop the release of the film</a>.</div><div><br /></div><div>In that case, the CDEL named the film studio Miramax, its distributors Roadside Attractions and director Bill Condon — as well as publisher Penguin Random House and screenwriter Mitch Cullin as defendants.</div><div><br /></div><div>Now, in a filing in the U.S. District Court in the District of New Mexico, the same jurisdiction as the previous lawsuit. Interestingly, that one claimed New Mexico was the appropriate venue since Cullin grew up there and met with John Bennett Shaw in the latter's Santa Fe home.</div><div><br /></div><div>Named as defendants: Nancy Springer, Penguin Random House, Legendary Pictures Productions, Netflix, PCMA Management and Productions, EH Productions UK, Jack Thorne, and Harry Broadbeer. An impressive, if similar group: one that would seem wide enough that the CDEL might be able to catch some fish.</div><div><br /></div><div>The question is whether their legal reasoning is as sound as last time.</div><div><br /></div><div>In this filing, the best they can do is to say that the Enola Holmes books were sold in the United States and Netflix is releasing the film in the United States, and since New Mexico happens to be one of those states, it should be the venue of the case. To say nothing of the state being the residence of the "corporate memory" of the CDEL.</div><div><br /></div><div>Before we get into the specific claims, let's review what we know from previous entries. [<i>For a full timeline of #FreeSherlock posts, <a href="https://www.ihearofsherlock.com/2015/05/conan-doyle-estate-sues-mr-holmes.html#.XvWd3UVKjb2" target="_blank">see the Timeline of Events in this link</a>. - Ed.</i>]</div><div><br /></div><div>When the CDEL sued over <i>Mr. Holmes</i>, it had the same modus operandi: the book had been published the decade before, yet it was only when a Hollywood payday — and a solidified release date — became apparent that the CDEL showed up with its hand out.</div><div><br /></div><div>In a 2014 decision, the 7th Circuit Court of Appeals landed this blistering observation over the case involving author Leslie S. Klinger:</div><div><blockquote>"The Doyle estate’s business strategy is plain: charge a modest license fee for which there is no legal basis, in the hope that the "rational" writer or publisher asked for the fee will pay it rather than incur a greater cost, in legal expenses, in challenging the legality of the demand. The strategy had worked with Random House; Pegasus was ready to knuckle under; only Klinger (so far as we know) resisted. In effect he was a private attorney general, combating a disreputable business practice—<b>a form of extortion</b>—and he is seeking by the present motion not to obtain a reward but merely to avoid a loss."</blockquote></div><div>Not only did they lose that judgement, but the CDEL <a href="https://www.ihearofsherlock.com/2014/08/7th-circuit-orders-conan-doyle-estate.html#.XvWhv0VKjb0" target="_blank">had to pay Klinger's legal fees</a> as well.</div><div><br /></div><div>Judge Posner, in his decision, counseled the business entity:</div><div><blockquote>"It’s time the estate, in its own self-interest, changed its business model."</blockquote></div><div>It's clear they did not heed that sage advice.</div><div><br /></div><div>In <a href="https://www.documentcloud.org/documents/6956021-Sherlock.html" target="_blank">the latest filing</a>, focusing on the last 10 stories that are in copyright, written between 1923 and 1927, the CDEL writes:</div><div><blockquote>"In World War I Conan Doyle lost his eldest son, Arthur Alleyne Kingsley. Four months later he lost his brother, Brigadier-general Innes Doyle. When Conan Doyle came back to Holmes in the Copyrighted Stories between 1923 and 1927, it was no longer enough that the Holmes character was the most brilliant rational and analytical mind. Holmes needed to be human. The character needed to develop human connection and empathy."</blockquote></div><div>Is this to say that Holmes did not exhibit human connection or empathy in the previous 50 stories? His reaction to putting Watson through a smoke-infused ritual in "The Devil's Foot" had plenty of emotion. His way with women in earlier cases made it clear he could employe empathy when he needed to get information out of them.</div><div><br /></div><div>Besides, is it reasonable to expect a court to grant trademark or copyright on the development of <i>emotions</i>?</div><div><br /></div><div>We thought the CDEL was desperate before. Either they're in dire need of funds or they're getting really poor legal advice. And that's just from this armchair lawyer's perspective.</div><div><br /></div><div>They're doubtless trying to push for a settlement, <a href="https://www.ihearofsherlock.com/2015/09/conan-doyle-estate-reaches-settlement.html#.XvWaHEVKjb0" target="_blank">just as they did with Miramax </a>over <i>Mr. Holmes</i>. Recall that the nefarious Harvey Weinstein ran Miramax. Strangely enough, he may not have been the only odious person in the room in that case.</div><div><br /></div><div>The method and mode of this lawsuit stinks. We've seen Holmes in the 20th, 21st, and even the 23rd centuries. Some adaptations have placed him in America or reworked him as a female Japanese detective. Most of the time, Dr. Watson is there in some form, although occasionally Holmes goes it alone. <div><br /></div><div>So imagine my surprise when I saw a fairly detailed synopsis of an <a href="http://ib.frath.net/w/Inspector_Watson">alternate history</a> in which the character of Sherlock Holmes didn't exist at all, and Hamish Watson was the famous hero! But let me back up a bit...<div><br />Recently I have been exploring a topic apart from Sherlock Holmes that I have long found fascinating: constructed languages, or as they are often called, conlangs. Conlangs range from Esperanto, a language created by a Polish ophthalmologist in 1887 (the same year a novel entitled <i>A Study in Scarlet</i> was published), to Klingon, a language created in the 20th century for the Star Trek franchise of films and TV shows. </div><div><br /></div><div>One of the hundreds of conlangs to show up in the 20th century was called Brithenig. It was created in 1996 by a linguist from New Zealand named Andrew Smith, as a "thought experiment" to answer one fascinating question: what might Latin have sounded like if it had more fully replaced the Celtic languages of the British Isles and developed alongside other Romance languages? </div><div><br /></div><div>To flesh out the answer to that question and provide a context for the language he created, Smith began to develop an alternate history he named Ill Bethisad (a phrase which in Brithenig means "the universe"). The Brithenig Project, as it was named in 1997, shortly became a <a href="http://ib.frath.net/w/Main_Page">collaborative wiki</a> that involved other people who had found Smith's conlang and alternate history intriguing, adding their own languages and other ideas to the world.<br /><br />In the alternate timeline of Ill Bethisad, several aspects of history are quite different from our own. For one thing, the American Revolution never happened, and so there is no country called the United States of America. Rather, the North American League, a federation of colonies and tribes with allegiance to several European monarchies, shares the North American continent, the map of which looks quite different from "our" America. Meanwhile, on the other side of the pond, the island of Great Britain is divided among the Federated Kingdoms, composed of England, Scotland, and Kemr (or "Cambria" in English). Kemr's main language is Brithenig, the conlang that began the whole project. And this is what leads us to the literary work of Sir Uther Conan Doyle, whose most famous character is the great detective...Inspector Hamish Watson!<br /><br /><br /><table align="center" cellpadding="0" cellspacing="0" class="tr-caption-container" style="margin-left: auto; margin-right: auto;"><tbody><tr><td style="text-align: center;"><img height="267" src="https://blogger.googleusercontent.com/img/proxy/AVvXsEh0_K-MhY2ZizmeP1i1I5lDnO9voum8gW6JY97FHwfy8g-qszL95oTXv4M4cEukceNebN81aypLfc-pysh3e3PnJRydwT7FshxdHFms59xl0vb40J3_oL2oKbk8FuD2zCBnXer6F5tB7rApj9rDR319VFhk6V9DbFVce8U=" style="margin-left: auto; margin-right: auto;" width="400" /></td></tr><tr><td class="tr-caption" style="text-align: center;"><i><font size="2">The flag of Kemr (Ill Bethisad's version of Wales)</font></i></td></tr></tbody></table><br />Although, to my knowledge, there are no actual stories extant which feature Inspector Watson, the Ill Bethisad wiki <a href="http://ib.frath.net/w/Inspector_Watson">article</a> about him is remarkably detailed. In the alternate history I've been describing, the character of Hamish Watson (often seen in "the long Inverness coat, the floppy broad-brimmed hat") is a beloved work of literary fiction, whose name is synonymous with the term "detective." </div><div><br /></div><div>Speaking of his name, Sherlockians will certainly find the name "Hamish" interesting, as many have speculated that the "H" in "John H. Watson" just might stand for "Hamish." Inspector Watson's sidekick and biographer is Sgt. Mycroft Jones. (I'm sure I don't need to point out the significance of the name "Mycroft.") </div><div><br /></div><div>The character makes his debut in The Mark of Fear in 1891; he eventually appears in five more novels and 66 short stories. Among the stories are some titles that will raise more than a few Sherlockian's eyebrows, such as "The Adventure of the Lemon Seeds" or "The Giant Rat of Bali" (a posthumously published tale).<br /><br />In 1901, Sir Uther, growing sick of his famous character, attempts to kill off Inspector Watson in the novel The Terrible Hand. As one can imagine, the public outcry is immense, and the article even mentions that "Watson’s demise was even blamed for contributing to the death of Queen Victoria!" (Another little point of departure from our timeline!) </div><div><br /></div><div>A couple of other details are quite interesting for the Sherlockian in our universe: the character of Hamish Watson was reportedly based on "a real person," William Sherlock Holmes, a famous private detective. And Sir Uther's son, also named Sherlock, died from "wounds sustained during the First Great War," an event which contributed to Uther's death of a heart attack in 1934. Meanwhile, the character's fame would spread, especially when he was portrayed by the gifted actor Sir Basyl Rathbone, who would play Watson in 20 films from 1939 to 1951.<br /><br />As I read the article about the great Inspector Watson and the bizarre but familiar world he "inhabited," I found myself wishing that some clever author would eventually pen all of the works described in this fabulously creative article of an alternate history where Sherlockians would presumably be called "Watsonians." </div><div><br /></div><div>This reminds me of one more detail that made me smile. In the world of Ill Bethisad, Inspector Watson lives at 221A Quaker Street, and many of his devoted fans call themselves--what else?—the "Quaker Street Irregulars." Among the ranks of the QSI are famed science fiction author Robert G. Heinlein and beloved politician <a href="http://ib.frath.net/w/William_Josiah_Clinton">William Josiah Clinton</a>. I can only imagine the spirited discussions they would have about the detective's famous dictum: "When you have excluded the impossible, whatever remains, however improbable, must be the truth—but the main difficulty lies in ensuring that all impossible contingencies have indeed been eliminated." </div><div><br /></div><div>And in case you were wondering, Watson's famous line, "Elementary, my dear Jones," is not canonical, but was made famous by Rathbone in the movie <i>The Cathedral of Secrets</i>. Of course it was!<div>

<li>Steele was a Michigander, born near Marquette in the Upper Peninsula (perhaps those "lumber camps of Michigan" that Birdy Edwards was so familiar with [VALL]).</li>
<li>He studied at the Art Students League and the National Academy when he came to New York.</li>
<li>Steele was the first living illustrator to have representation in the Cabinet of American Illustration of the Library of Congress.</li>
