After seven years playing Sir Arthur Conan Doyle's infallible detective, actor Basil Rathbone, a Brit by way of Johannesburg, would reveal a gnawing disdain for Sherlock Holmes.<br />

"One was jealous of course," he writes in his 1956 autobiography, <a href="http://amzn.to/1o1mVXZ" rel="nofollow" target="_blank"><i>In and Out of Characte</i>r</a>.<br />

"Jealous of his mastery in all things, both material and mystical…he was a sort of god in his own way, seated on some Anglo-Saxon Olympus of his own design and making! Yes, there was no question about it, Holmes had given me an acute inferiority complex!"</blockquote>
<br />
Indeed, between 14 films and 200 radio broadcasts, Rathbone came to recognize his own limitations in 19th century fiction. But it was a burden that nonetheless became his legacy. He created an icon: Inverness cape, slung around lean shoulders; a hawkish nose; a <a href="http://www.ihearofsherlock.com/2014/01/the-basil-rathbone-hat-mystery.html" rel="nofollow" target="_blank">visored cap</a>; a <a href="http://pipesmagazine.com/blog/tag/sherlock-holmes-did-not-smoke-a-calabash-pipe/" rel="nofollow" target="_blank">curved pipe</a>.<br />
<br />
The silhouette that has inspired new generations of backyard and on-screen antiheroes.<br />
<br />
"It's <a href="http://www.ihearofsherlock.com/2014/03/marking-75-years-of-this-classic.html" rel="nofollow" target="_blank">acknowledged</a> that there has been no other actor before and probably since, with the possible exception of (Jeremy) Brett, who achieved such a physical realization of Conan Doyle's protagonist," explained Neve Rendell, editor of <a href="http://thegreatbaz.wordpress.com/" target="_blank">The Baz: A Basil Rathbone Blog</a>, in an interview with IHOSE. "It's been said he is in some ways the <a href="http://www.arthes.com/holmes/" target="_blank">(Sidney) Paget</a> drawings come to life."<br />
<br />
Classically-trained -- a contemporary of Laurence Olivier -- Rathbone easily slipped into the Canon's conception of Holmes as artful, Victorian sleuth. Twentieth Century Fox's <a href="http://amzn.to/1fd2jJA" rel="nofollow" target="_blank"><i>The Hound of the Baskervilles</i></a> and <a href="http://amzn.com/B0001DCYB4" target="_blank"><i>The Adventures of Sherlock Holmes</i></a> (1939) then integrated motifs relic of the <a href="http://www.spreaker.com/user/attaboyclarence/the-game-is-afoot" target="_blank">Golden Age of Hollywood</a>. A misty, lantern-lit moor (a wink at the era's popular Gothic horror flicks). A fusty, bumbling companion. A villain -- and a <a href="https://www.youtube.com/watch?v=XmJVXHLjVhk" rel="nofollow" target="_blank">vaudevillian tonic</a>.<br />

When Universal Studios rebooted the series in 1942, in the heart of World War II, Rathbone <a href="http://www.sherlockpeoria.net/AaaView/View2012/ViewSP042912.html" target="_blank">grew into</a> a fedora-wearing action man.<br />
<br />
"Given the massive popularity of Rathbone's Holmes at the time, it was inevitable to induct him into the <a href="http://www.chaplinbooks.co.uk/SecretWeapon.pdf" target="_blank">fight against Nazism</a>, both on- and off-screen -- to promote the sale of war bonds and in support of the British War Relief," said Rendell, who started her website in 2012. "His quintessential 'British-ness' must have helped a great deal at a time when FDR was trying to win American popular opinion in going to war and supporting Europe."<br />
<br />
Despite his and Holmes' trans-Atlantic influence -- what journalist <a href="http://www.ihearofsherlock.com/2014/02/episode-61-private-life-of-vincent.html" rel="nofollow" target="_blank">Vincent Starrett</a> immortalized in his poem <a href="http://www.ihearofsherlock.com/2013/10/celebrate-national-poetry-day.html#.U405ovldWSo" rel="nofollow" target="_blank">"221B"</a> -- Rathbone began to resent the light treatment of Conan Doyle's weighty work. He cringed when fans cried "Quick, Watson, the needle" or "Elementary, my dear Watson!" He dreaded typecasting.<br />
<br />
And, he said, he feared "oblivion" for portraying someone who, "for a brief, beautiful period, was more real than reality itself."<br />
<br />
Yet in the hearts and minds of all who followed him, from Brett to Cumberbatch, Rathbone personifies Holmes. Call it typecasting but, really, it is much more. It is iconic. With the swish of his Inverness and the puff of his pipe, Rathbone brought the world's first consulting detective to life. He made us laugh. He made us forget. To that, it's "Good-day, sir; good-day."<br />

Long before Jeremy Brett assayed the role of the Sage of Baker Street, another Brett had worn the mouse-colored dressing gown. Eille Norwood (1861-1948) was born Anthony Edward Brett. For his stage name, he took Norwood from the London suburb where he lived (and which features in <i>The Sign of Four</i> and "The Norwood Builder") and Eille a variant of the first name of a former flame Eileen.<br />
<br />
In the early 1920s he starred in a series of films for Stoll Picture Productions Ltd. based on Doyle’s original stories. Fifteen shorts under the general title of <i>The Adventures of Sherlock Holmes</i> were released in 1921, as was the feature length <i>The Hound of the Baskervilles</i>; fifteen more called <i>The Further Adventures of Sherlock Holmes</i> in 1922; the final fifteen as <i>The Last Adventures of Sherlock Holmes </i>in 1923 along with <i>The Sign of Four</i>. <br />
<br />
Norwood had a compulsion to get his Sherlock Holmes right. According to Alan Barnes in <a href="http://amzn.to/1tYDjdu" rel="nofollow" target="_blank"><i>Sherlock Holmes on Screen</i></a> “Norwood’s greatest contribution was his sheer diligence: he re-read all the Holmes stories to date prior to beginning work, learned scratch violin-playing and would study Strand magazine artist Sidney Paget’s Holmes illustrations for clues to costume and even posture.” Barnes also notes Norwood’s very Holmesian talent with make-up and disguise:<br />

Another much-repeated anecdote has [managing director of Stoll Pictures] Jeffrey Bernerd attempting to have a ‘common-looking’ cabby removed from the set of <i>A Scandal in Bohemia</i>, completely unaware that the insalubrious ‘cabby’ was none other than Norwood wearing one of Holmes’ many disguises. Bernerd’s embarrassment was compounded by his earlier claim that Norwood would never be able to alter his stature and physique to the extent this particular disguise demanded."</blockquote>

Like the original short stories when they first appearing in the Strand, Stoll’s Holmes films were a hit with the public. And with early Sherlockians as well. Vincent Starrett in <a href="http://www.wessexpress.com/html/privatelife.html"><i>The Private Life of Sherlock Holmes</i></a>: “Needless to say, when Mr. Norwood made up as Sherlock Holmes, he looked like Sherlock Holmes. His pictures were a trifle slow, but in fidelity to theme and period they frequently surpassed their more elaborate successors. All of the more famous tales were filmed for Norwood, and one at least—the Hound—was serialized.” Daniel Stashower reports in <a href="http://amzn.to/1tvUpxn"><i>Teller of Tales: The Life of Arthur Conan Doyle</i></a>: “Conan Doyle heartily approved of Norwood’s performance. At a 1921 testimonial dinner, he enthused over the actor’s ‘extraordinarily clever personation,’ adding that he had ‘never seen anything more masterly’ than Norwood’s performance in The Hound.”<br />
<br />
Almost all of Norwood’s films have survived as “preservation material” but are rarely seen. The 2009 DVD <a href="http://amzn.to/U2c4T0"><i>Sherlock Holmes: The Archive Collection Vol. One</i></a> contains <i>The Man with the Twisted Lip</i>. Now, if you are in the San Francisco area from May 29 to June 1 you can experience Eille Norwood as Doyle did, on the big screen at the <a href="http://silentfilm.org/">San Francisco Silent Film Festival</a> 2014 at the historic <a href="http://www.castrotheatre.com/">Castro Theatre</a> (429 Castro Street, San Francisco, California). The festival showcases 17 silent features including 1923’s The Sign of Four on Sunday, June 1 at 5:00 pm.<br />
<br />
The early 20th century saw many actors take on the role of Sherlock Holmes and Norwood is considered one of the best impersonators. In the last installment of the case of <i>Klinger v. Conan Doyle Estate, Ltd</i>., we were aware that the <a href="http://free-sherlock.com/2014/01/27/january-2014-news-release-re-appeal/" target="_blank">CDE had until March</a> to file for an appeal, which it did. You'll recall the <a href="http://www.ihearofsherlock.com/2013/12/special-episode-free-sherlock.html#.U37Z5PldWSo" rel="nofollow" target="_blank">discussion we had with legal scholar and Baker Street Irregular Betsy Rosenblatt on the Special Episode</a> in December. There's a great background of the case and next steps in that audio recording. Here is <a href="http://www.ihearofsherlock.com/search/label/%23FreeSherlock#.U37Z6PldWSp" target="_blank">all of the coverage we've had</a> of the case to date.<br />
<br />
It was entirely appropriate then, that the appeal hearing should take place on May 22 - Sir Arthur Conan Doyle's birthday. And it was even more momentous that we Brenda Rossini, an avid Sherlockian, was in attendance at the Seventh Circuit Court of Appeals in Chicago for the appeal. The panel consisted of judges Flaum, Posner, and Manion.<br />
<br />
It should be noted that <a href="http://www.law.uchicago.edu/faculty/posner-r" target="_blank">Judge Richard Posner</a> is a legal scholar of some renown and a well-read jurist; in fact, <a href="http://www.law.uchicago.edu/news/posner101104" target="_blank">he reviewed <i>The New Annotated Sherlock Holmes</i></a>, in which he noted that the "Holmes stories and the Holmes persona seem to me wildly overrated, and this annotated edition an eccentric venture."<br />
<br />
With that unflattering review, we now turn it over to the observations of Ms. Rossini:<br />
<blockquote class="tr_bq">
Judge Posner was indeed on the panel; the Klinger v. CDE case was preceded by a number of lawyers -- at times fatuous, unimaginative, incapable of going beyond the four corners of their arguments and at wit's end when Posner interrupted (repeatedly, as in "Answer the question...Yes or No...not "If'," and that was the less brutal).<br />
<br />

<br />
<b>For the Appellant/Conan Doyle Estate</b>, soft-spoken, precise, cautious Benjamin Allison:<br />
Like a racehorse, Posner interrupted within seconds, and the tenor of which, was words such as "threats," "spurious," "incomprehensible."<br />
<br />
Soft-spoken Mr. Allison began with his legal argument (set forth in the Brief, so why bother repeating what's in the judges' hands?) that Klinger had merely asked for an advisory opinion of the lower court, and that the decision of the lower court should be reversed. Posner didn't like this tack one bit:  Klinger had to resort to the court because You (Posner's pronoun) said you'd sue. You used a threat.<br />
<br />
He said Klinger's was a justiciable case. He rejected Allison saying that it had no "immediacy or reality."  Posner scoffed then and scoffed throughout.<br />
<br />
More words from the Posner:  "You put Klinger in a terrible box and caused him to spend a lot of money, and you made your threats."<br />
<br />
Allison tentatively objected to using the word "threat."  But Posner said when you say "it's all copyrighted and you can't do that, you're making a threat."<br />
<br />
(if the facts are on your side, pound the facts; if the law is on your side, pound the law; if neither the facts nor the law are on your side, pound the table.)<br />
<br />
Another thing that annoyed Posner was the use of a "mural" to pose the ACD argument-- that SH and Watson are all part of the big picture.<br />
<br />
He went on and on about the mural--it really got under his thin skin-- and finally forced Allison to "abandon the mural argument." Posner also managed to weave in the memorable "Your argument is incomprehensible."<br />
<br />
Posner said the ACD estate was being ambitious and aggressive in seeking to enlarge a copyright so no one could use what was properly in the public domain.<br />
<br />
"What do you regard as non-violative?" he asked Allison.  No answer.<br />
<br />
"What you're asking is "the irresistible temptation for any copyright owner to perpetuate a copyright."  "It's a game being played here."<br />
<br />
Posner stated explicitly that the "46 stories" (which Appellee corrected later as 50) are no longer copyrighted. They are in the public domain; Klinger can do anything he wants with them. He is not infringing when he uses them.  Klinger was not asking to infringe, "but to get the Conan Doyle Estate 'off his back.'"<br />
<br />
He advised the CDE to simply set out the limits for Klinger; he will be cautious and not violate the copyright on the 10 remaining stories. He will acknowledge that he can do whatever he wants as long as he doesn't infringe on the copyright of the latter 10.<br />
<br />
<b>Appellee Jonathan Kirsch for Klinger</b> -- brilliant, florid, lucid, imaginative, in control of the panel. He spoke, they listened.<br />
<br />
He began at the outset, forcefully, with the "fog of uncertainty" metaphor," where people are made to pay by the intrusive CDE, which they prefer to do rather than incur lawsuit fees.<br />
<br />
He said Klinger wanted the declaratory judgment, quick, simple, less expensive, so far as the 50 works being in the public domain, and as a final resolution.<br />
<br />
Posner apparently agreed, and said further, provocatively, "Did you think of filing an action for tortious interference?" with what the CDE was doing with Amazon?<br />
<br />
Jonathan responded that the publisher hadn't wanted to incur fees once learning of the Estate's purported interest, and Klinger didn't want toincur the time and expense in intense litigations.<br />
<br />
I might add that Posner (ingenously) queried Jonathan on whether or not Klinger had published previously. We all know that Judge Posner reviewed, with jaundiced eye, Klinger's annotated in <i>The New Republic</i>, back in 2004.<br />
<br />
When Allison returned for his last go-round, Posner was still on the attack: "You want to tie anyone in knots who wants to write a Sherlock Holmes story."<br />
<br />
"You have a vague notion of what you want...waving your arms and making huge circles. You're trying to intimidate."</blockquote>
<br />
So there you have it. We're not lawyers, nor do we play one on TV, but it seems fairly straightforward to us. We'll await the final opinion of the court. What do you think the outcome will be?<br />
