It maybe hard to believe that the whole world does not know of <a href="http://www.ihearofsherlock.com/2013/02/imagine-that-you-can-bully-me-chas_14.html">Klinger vs. Conan Doyle Estate Ltd.</a> One can read of the lawsuit in <i style="mso-bidi-font-style: normal;">The New York Times</i>, <i style="mso-bidi-font-style: normal;">The Economist, <a href="http://www.businessweek.com/articles/2013-03-08/the-man-whos-trying-to-free-sherlock-holmes">Bloomberg Businessweek</a></i>  and hear of it on NPR. Certainly, it must be on the lips of every Sherlockian and every Sherlockian must have an opinion on the matter. It was a topic on<a href="http://www.ihearofsherlock.com/2013/04/episode-51-who-is-sherlockian.html"> <i style="mso-bidi-font-style: normal;">I Hear of Sherlock Everywhere</i></a>  and Les Klinger has been interviewed by the <a href="http://bakerstreetbabes.com/podcast/episode-38-free-sherlock/">Baker Street Babes</a>. In brief, according to the <a href="http://free-sherlock.com/">Free Sherlock</a>:

<span style="color: blue;">Klinger seeks to have the Court determine that the characters of Sherlock Holmes and Dr. John H. Watson are no longer protected by federal copyright laws and that writers, filmmakers, and others are free to create new stories about Holmes, Watson, and others of their circle without paying license fees to the current owners of the remaining copyrights.</span></div>

<span style="color: blue;">Klinger says that the litigation came about because he and Laurie R. King, best-selling author of the “Mary Russell” series of mysteries that also feature Sherlock Holmes, were co-editing a new book called “In the Company of Sherlock Holmes.”  This collection of stories by major mystery/sci-fi/fantasy authors inspired by the Holmes tales, is to be published by Pegasus Books. “The Conan Doyle Estate contacted our publisher,” says Klinger, “and implied that if the Estate wasn’t paid a license fee, they’d convince the major distributors not to sell the book. Our publisher was, understandably, concerned, and told us that the book couldn’t come out unless this was resolved….</span></div>

<span style="color: blue;">“This isn’t the first time the Estate has put pressure on creators,” Klinger adds. “It is the first time anyone has stood up to them. In the past, many simply couldn’t afford to fight or to wait for approval, and have given in and paid off the Estate for ‘permission.’ I’m asking the Court to put a permanent stop to this kind of bullying. Holmes and Watson belong to the world, not to some distant relatives of Arthur Conan Doyle.”</span></div>

Some have taken the Free Sherlock movement to heart. They have “taken up arms”, spiritually if not financially, with Klinger and see the seal of the <a href="http://www.conandoyleestate.co.uk/">Conan Doyle Estate Ltd.</a> as something undesirable. This is where 221B Cellars come in to the story. Vintners and Sherlockians, 221B Cellars sent out a mailing offering their 2012 vintage A Study In Scarlet wine, which also featured the Estate seal. This struck some well-meaning FreeSherlockians as a political statement and left them disinclined to sample the Cellars wares.</div>

Don Libey of 221B Cellars was puzzled. As he explained on the <a href="http://www.221bcellars.com/221b-cellars-blog.html">site’s blog</a> on April 27, he was unaware of controversy surrounding the Estate and, indeed, thought he was doing the right thing: </div>

<span style="color: blue;">We have always been respectful of the U.S. copyright laws and comply with the display of the seal and wording as specified by the license. We do this on the wine and on our books. We thought (and continue to believe) that copyright law requires one to meet the conditions of licenses and contracts, and we do so freely as we live in a society and nation of laws. Apparently, there is some disagreement among Sherlockians regarding that responsibility, and when and if the copyright law is changed, we will comply with the lawful changes. And, frankly, we are also respectful and appreciative of Sir Arthur Conan Doyle for what he has given us over so many years.</span></div>

He further explained the finances involved with A Study In Scarlet wine:</div>

<span style="color: blue;">The wine is priced at $39 a bottle plus shipping. It costs us $21 a bottle, including a $1.50 licensing fee to The Doyle Estate Ltd. There   is little profit in making one barrel of wine for anyone. Of the $18 gross profit, we will donate a total of $9 (50% of profits), giving $4.50 to the University of Minnesota and $4.50 to the Napa Valley Napoleons of S.H. We hope they will use these small donations for educational or research purposes to further Sherlockian studies, perhaps focusing on youth. <br /><br />We are also donating (no cost) 2 bottles to the Baker Street Irregulars and 1 bottle to The Sherlock Holmes Society of London. We hope  they will auction them off and raise a few dollars for furthering Sherlockian  studies (the wine and the shipping will cost me, personally, about $120, and that's my  money).<br /><br />The other half of the profit leftover ($9) we will reserve to partially pay for the production of one barrel next year of <i>The Hound of the Baskervilles</i>, a first edition Zinfandel. Again, only 200 bottles will be made. Yes, we have $9 of <i>GROSS</i> profit (not Net Profit) on a bottle, but this doesn't even begin to cover the advertising expense (we spent $250 on the back page of <i>The Baker Street Journal</i> for this  summer, and that helps the BSI and <i>The Baker Street Journal</i> even more), the $400 in printing and postage for the advertising card mailing, the $1,000 cost of a French oak barrel to age the wine in,  the label costs of $300, etc., etc., etc.  I figure if we are successful…this project is only going to cost me about $2,500 of my own money. But, hey...that's what old Sherlockians do to have fun. Some go to Switzerland and visit the falls before they themselves go over the falls; instead, we made 200 bottles of wine for what we thought was a good purpose</span>.</div>

The question arises, should a FreeSherlockian boycott 221B Cellars? Does the $1.50 that goes to the Estate negate the $9.00 that goes to charity and $9.00 of the Cellars gross profit? If so, does that mean to be ideologically pure one must boycott all who are licensees? After all, many Holmes-related titles published in the U.S. in recent years have been licensed by the Estate, whether with an official seal on the cover or an acknowledgement in small print in the front matter. <a href="http://www.amazon.com/Dust-Shadow-Account-Ripper-Killings/dp/B004J8HWYQ">Lyndsay Faye’s <i style="mso-bidi-font-style: normal;">Dust and Shadow</i></a>, <a href="http://www.amazon.com/Italian-Secretary-Further-Adventure-Sherlock/dp/0312352042">Caleb Carr’s <i>The Italian Secretary</i></a>, <a href="http://www.amazon.com/The-House-Silk-Sherlock-Holmes/dp/0316197017">Anthony Horowitz’s <i>The House of Silk</i> </a>, <a href="http://www.youngsherlock.com/">Andrew Lane’s Young Sherlock Holmes</a> series, even <a href="http://www.amazon.com/New-Annotated-Sherlock-Holmes-Complete/dp/0393059162">Leslie Klinger’s </a><i style="mso-bidi-font-style: normal;"><a href="http://www.amazon.com/New-Annotated-Sherlock-Holmes-Complete/dp/0393059162">The New Annotated Sherlock Holmes</a> </i>have an association with the Estate. As does Warner Bros. Sherlock Holmes movie series with Robert Downey Jr. and Jude Law, CBS’ <i style="mso-bidi-font-style: normal;">Elementary</i>, and PBS’ <i style="mso-bidi-font-style: normal;">Masterpiece Mystery!</i> when it airs <i style="mso-bidi-font-style: normal;">Sherlock</i>. The pure ideologue will end up with pretty bare shelves when they are done eliminating the taint of the Doyle Estate.</div>

I emailed Les Klinger and asked him about the issue of boycotting Estate licensees. He had this reply:<br />

<span style="color: blue;">While I appreciate the sentiment, I don’t think that a boycott is fair. Many licensees have been pressured into obtaining licenses, and not everyone has the freedom (that is, the time or the money) to stand up to the Estate’s bullying and threats of blocking sales. </span></div>

<span style="color: blue;">I do have a problem with flaunting “authorized” status, as in the case of <i>The House of Silk</i>. I wrote about this in my review of that book for the <a href="http://www.theglobeandmail.com/arts/books-and-media/the-house-of-silk-by-anthony-horowitz/article4248100/"><i id="yui_3_7_2_1_1367503880577_2676">Toronto Globe & Mail</i></a>. What makes an “authorized” product better than an unauthorized one? That is a more subtle issue, however, than the basic question of whether one <i>must</i> be authorized to sell wine. I find that position ludicrous. The Estate does <i>not</i> own a trademark in the name “221B” or “Sherlock Holmes” and will have a very difficult time establishing their case. There is no copyright infringement that I can see even possible in calling one’s wine “221B Cellars” or using the name or logo of Holmes in marketing it. There are hundreds of businesses that do so.</span></div>

In a follow up email to me he added, “<span style="color: black;">If the owners of 221B Cellars choose to obtain a license, that is their decision; however, they should not be legally compelled to do so under a baseless threat of restraint.</span>” </div>

<span style="color: black;">What should a FreeSherlockian do? Should they shun all those hold truck with the Estate, or perhaps have certain exceptions like a vegetarian who none the less cannot pass up veal marsala because it tastes so good? If the Conan Doyle Estate Ltd. is Charles Augustus Milverton, </span>the king of all the blackmailers who would use Holmes, then are we to paint the victims of “bullying and threats” with the same brush and find them no better than the blackmailer? Who would suffer under such a boycott, the blackmailer or the victim? Or should FreeSherlockians go about their Sherlockian lives, support Les Klinger and let the courts decide the matter?</div>

In the very first episode <a href="http://en.wikipedia.org/wiki/Stonyhurst_College" style="color: black; outline: 0px;" target="_blank" title="Stonyhurst College">Stonyhurst College</a>, the Jesuit school which <span style="font-weight: 700;">Arthur Conan Doyle</span> attended, was featured. I haven’t had a chance to view it yet but <span style="font-weight: 700;"><a href="http://alistaird221b.blogspot.com/2013/06/britains-secret-homes.html" style="color: black; outline: 0px;" target="_blank" title="Duncan critical of Stonyhurst segment">Alistair Duncan</a></span> posted a piece that was highly critical of the episode saying that “it was not exactly right to imply that the [Stonyhurstlibrary] and ACD’s memories of it led to the creation of <em>The Hound of the Baskervilles</em>." Most of what’s discussed resides solely in the confines of internal BSI politics, leaving Keefauver to conclude that “most Sherlock Holmes fans these days don’t care a whit about everything I just wrote;" only time will tell. The Baker Street Irregulars are widely known as a literary society dedicated to the study of Sherlock Holmes. Since 1934 the group has been gathering in New York City for <a href="http://bsiweekend.com/" style="font-weight: bold;">its annual dinner and weekend festivities</a> and has embarked on <b><a href="http://bakerstreetjournal.com/itemsforsale.html">a significant publishing effort</a></b> centered around<b><a href="http://bakerstreetjournal.com/itemsforsale/bsihistoryseries.html"> its own history</a></b>, <b><a href="http://bakerstreetjournal.com/itemsforsale/bsiinternationalseries.html">international Sherlockian societies' scholarship</a></b>, and analysis of extant <b><a href="http://bakerstreetjournal.com/itemsforsale/bsimanuscriptseries.html">manuscripts of the Canon</a></b>.<br />

But more than that, the BSI wants to ensure that its own history and that of its members are recorded for posterity and the researchers who may be interested in it sometime in the future. Enter <a href="http://bsitrust.org/" style="font-weight: bold;">the Baker Street Irregulars Trust</a>.<br />
<br />
In this episode, Burt and Scott interview Tom Francis, BSI ("The Imperial Opera at Warsaw), who is the Chair of the Trust. Tom helps us understand how and why the Trust was established, what its aims are, and how you can help this august institution. We discuss some of the holdings of the Houghton Library at Harvard University, where the Trust is housed, including the H.W. Bell collection - Bell having been an early Sherlockian scholar and member of The Speckled Band of Boston.<br />

The BSI Trust is a nonprofit organization as a subset of the Baker Street Irregulars. Donations are welcome, but original materials are more desirable. Correspondence of Irregulars and their other papers are welcome - but the Trust does is not interested in everything Sherlockian or related to all Sherlockian societies. Books and other items that are not a core part of the Trust typically go up for sale or auction.<br />

Tom breaks ground as he utters a phrase never before heard on this program - tune in to find out exactly what that is - and even begins to delve into what the future of the Trust looks like in our digital/electronic times.<br />

Curley + Associates (GMCA), and OMSI, this unique and interactive experience showcases areas of forensic science that enabled Sherlock Holmes to solve crimes, as well as the historic underpinnings of author Sir Arthur Conan Doyle’s rich and vibrant stories.<br />

<a href="https://www.blogger.com/null" name="more"></a>In an effort to give visitors a sense of the world of Sherlock Holmes, how he used forensic science to help solve crimes, and the influence of Sir Arthur Conan Doyle's life, the exhibition will feature the following displays:<br />
<ul>
<li><b>Dr. Conan Doyle’s Study</b> – Conan Doyle, a scientifically educated physician, was a curious and tireless investigator his entire life. Guests will discover his world first as a medical student at Edinburgh University, then as an apprentice at Royal Surgeons’ Hall there, and finally as a creator of literary genius while practicing medicine in Southsea, Portsmouth, in the 1880s, and London in the early 1890s. On display will be an original manuscript, letters, and illustrations through which guests will gain perspective on the experiences that influenced Conan Doyle in creating Sherlock Holmes.</li>
<li><b>Science and History</b> – Sherlock Holmes solved mysteries using observation and solid scientific experimentation, something real-world detectives (police or private) had not yet embraced. Guests will participate in experiments of their own by exploring the developments in science and technology in the 1890s, developments still very relevant today. Supported by forensics expert and crime historian E. J. Wagner, author of <i><b><a href="https://amzn.to/2TTHtt0" rel="nofollow" target="_blank">The Science of Sherlock Holmes</a></b></i>, the exhibition digs into real forensic studies in order to demonstrate the link between the Sherlock Holmes stories’ detective science and the world of today.</li>
<li><b>Sherlock Holmes in Baker Street</b> – Guests will visit Sherlock Holmes’ and Dr. Watson’s sitting-room at 221B Baker Street, London, where their investigations began and concluded – a room looming large in popular imagination around the globe ever since the first Sherlock Holmes tale A Study in Scarlet in 1887. Of it, poet Vincent Starrett said: “Here dwell together still two men of note / Who never lived and so can never die . . .Here, though the world explode, these two survive / And it is always eighteen ninety-five.” </li>
<li><b>Become a Detective </b>– Guests will replace the museum map with a book full of clues while hot on a trail to solve a remarkable murder. Using their own powers of observation, guests can crack a new Sherlock Holmes mystery written exclusively for this exhibition by <b><a href="http://www.ihearofsherlock.com/2007/11/episode-13-arthur-conan-doyle-life-in.html" target="_blank">Daniel Stashower</a></b>, the acclaimed historian, award-winning Conan Doyle biographer (author of <b><i><a href="https://amzn.to/2Gl0koM" rel="nofollow" target="_blank">Teller of Tales: The Life of Arthur Conan Doyle</a></i></b> and co-editor of <b><i><a href="https://amzn.to/30P6SFl" target="_blank">Arthur Conan Doyle: A Life in Letters</a></i></b>), and author of new Sherlock Holmes stories as well.</li>
<li><b>Culture of Sherlock</b> – Pop culture enthusiasts will enjoy the exhibition’s final gallery, housing a robust collection of all things “Sherlockian,” ranging from vintage Sherlock Holmes-themed card games, comics, and magazines, to radio broadcasts, movie clips, and television shows. Featured are costumes worn by Robert Downey Jr. and Jude Law in Warner Bros.’ current Sherlock Holmes movies set in the Victorian era, alongside costumes and props from the CBS hit television show Elementary, setting Sherlock Holmes in present day. The exhibition will offer museum guests the most comprehensive display anywhere of Sherlock Holmes in the popular imagination over the 126 years since his creation. The conclusion of the exhibition celebrates today’s real forensic scientists and their exceptional work.</li>

The last two days mark birthdays of three legendary actors associated with Sherlock Holmes. Each is known beyond his Sherlock Holmes work, but together their collective Sherlockian CVs are impressive.<br />

<a href="http://en.wikipedia.org/wiki/Peter_Cushing" target="_blank">Peter Cushing</a>, <a href="http://en.wikipedia.org/wiki/Vincent_Price" target="_blank">Vincent Price</a> and <a href="http://en.wikipedia.org/wiki/Christopher_Lee" target="_blank">Christopher Lee</a> are icons of the screen spanning the majority of the 20th century and into the 21st. They all had a significant impact on the noir, horror and sci-fi realms and had cheekbones that could cut glass.<br />
<br />
So let's take a look at these three gentlemen on the anniversaries of their birth and on how they touched the world particularly through their Sherlock Holmes-related roles.<br />
<h3>
<br />
"Lee a gentleman" [TWIS]</h3>
We'll start with Sir Christopher Lee, as his association with the great detective is the most impressive. On May 27, 2013 Christopher Lee turned 91. He appeared in the 1959 Hammer version of <b><i><a href="https://amzn.to/3z2o4ui" target="_blank">The Hound of the Baskervilles</a></i></b> as Sir Henry Baskerville, alongside Peter Cushing's Sherlock Holmes.  Then, in 1962, Lee took a turn as Sherlock Holmes himself in the 1962 film <b><i><a href="https://amzn.to/3MMnsNo" target="_blank">Sherlock Holmes and the Deadly Necklace</a></i></b>.<br />

Then eight years later, Lee was to do what no other actor had done until then or has done since: he went from playing Sherlock Holmes to playing Mycroft Holmes. He lost the deerstalker (and his toupee) and joined Robert Stephens in Billy Wilder's <i><b><a href="https://amzn.to/3yXaUi3" target="_blank">The Private Life of Sherlock Holmes</a></b></i> in 1970, in a fantastical plot that involved Loch Ness, a submarine and <a href="https://www.youtube.com/watch?v=eRuUnXjMxZ0" target="_blank">a visit from Queen Victoria</a> herself.<br />

Then, in the early 1990s, Lee teamed up with Patrick Macnee as his Watson and made two films: <i><a href="https://amzn.to/3NDSLtI" target="_blank"><b>Incident at Victoria Falls</b></a></i> and <i><b><a href="https://amzn.to/3wSTwIC" target="_blank">Sherlock Holmes and the Leading Lady</a></b></i> that took a look at Holmes in his retirement years.<br />
<br />
Finally, Lee took on the job of host in <b><i><a href="https://amzn.to/39TkUP0" target="_blank">The Many Faces of Sherlock Holmes</a></i></b>, in which he took us through the legion of actors who have portrayed the master detective throughout the years on stage, television and film. It's a fun overview, and while incomplete by today's standards, as we've had two decades of Holmeses since then, it helps to ground viewers in some of the popular manifestations of Sherlock Holmes throughout the years. We highly recommend picking up a copy of the DVD (available in the above link).<br />

"Cushing was horrified" [CARD]</h3>
May 26, 2013 marks the centenary of Peter Cushing's birth. Born in 1913, Cushing graced the large and small screen as Sherlock Holmes over the course of a number of decades. As we mentioned above, Cushing had a turn in <i>The Hound of the Baskervilles</i> (1959), with Andre Morrell as his Watson. Then, it was to return to him in the mid-1960s when Douglas Wilmer gave up the role on <b><a href="https://amzn.to/38KFuRC" target="_blank">the BBC television series for 16 episodes</a></b>.<br />

The series was well received and is critically acclaimed now despite the hectic production schedules that put the actor on timetables of less than two weeks for each episode. The final episode was "The Blue Carbuncle," and by that time, viewers could see the close and amiable relationship Cushing had developed with his Watson, Nigel Stock. We commented on the very same thing during <b><a href="http://www.ihearofsherlock.com/2012/12/episode-49-ill-have-blue-christmas.html" rel="nofollow" target="_blank">Episode 49 of I Hear of Sherlock Everywhere</a></b>.<br />

Cushing returned to the screen in the 1984 film <i>Sherlock Holmes and the Masks of Death</i> looking quite elderly, with an equally aged John Mills by his side. But his relationship with Holmes was not merely through his career; Cushing was genuinely interested in the Canon. In fact, he was an active member of the Sherlock Holmes society <b>The Northern Musgraves</b>, and the group even adopted his freehand sketch of Holmes as their official logo (second image below). Those interested in the more private, tender and humorous side of the actor would do well to pick up a copy of the biography <b><a href="https://amzn.to/3aqv363" target="_blank"><i>Peter Cushing: A Life in Film</i></a></b> as well.<br />

"And you, Mr. Price?" [STOC]</h3>
Our final entrant in this triumvirate of Sherlockian birthdays is none other than Vincent Price, who would have been 102 years old on May 27, 2013. Price made his debut in the horror genre in the 1939 film <i>Tower of London</i> with Boris Karloff, and was seemingly typecast from then on. His career spanned over five decades, and Price had two very significant associations with Sherlock Holmes along the way.<br />

One was his portrayal of the evil Moriarty-inspired Professor Ratigan in <b><i><a href="https://amzn.to/3PV9MBQ" target="_blank">The Great Mouse Detective</a></i></b> (1986). Price had always wanted to portray the voice of a Disney character, and this film allowed him to do just that. His portrayal is classic Vincent Price, moving from charming dark humor to pure evil with a seeming blink of an eye.<br />

Also during that time (from 1981-1989, to be exact), Vincent Price was the host for the PBS production of <b><i>Mystery!</i></b> which featured such detectives as Hercule Poirot, Miss Marple, Albert Campion, Adam Dalgliesh, Father Brown, Inspector Morse, Lord Peter Wimsey, Horace Rumpole and of course, Sherlock Holmes. <a href="http://www.ihearofsherlock.com/2014/05/one-of-best-features-of-jeremy-brett.html" rel="nofollow" target="_blank">Price's introductions for the Granada series</a> starring Jeremy Brett were as rich in setting as the episodes themselves. Friends of ours in the Baker Street Irregulars and The Speckled Band of Boston contributed to the writing of these, as well as to the set decoration.<br />

Sadly, these introductions are not part of the DVD collections of the Granada series that one may purchase,  but some are still available on YouTube today.
